If you are a U.S. employer, I-9 compliance has never been more important. Worksite enforcement by Homeland Security Investigations (HSI), a division of U.S. Immigration and Customs Enforcement (ICE), has surged dramatically under the current administration, and the consequences of noncompliance have never been more severe.

A Tenfold Increase in Enforcement Activity

ICE's rate of Notices of Inspection (NOIs) in the first half of 2025 was at least ten times higher than in all of 2024. The federal government has allocated unprecedented resources to worksite enforcement, including the hiring of 10,000 new enforcement agents and over $170 billion in enforcement funding under the One Big Beautiful Bill Act signed in July 2025. Employers across every industry — from restaurants and hospitality to manufacturing, construction, and professional services — have been targeted.

What Penalties Look Like in 2026

I-9 penalties in 2026 range from $288 per paperwork error to $28,619 per violation for knowingly hiring unauthorized workers. These penalties can quickly compound into six or seven-figure liabilities for employers with large workforces or systemic compliance failures.

HSI's Expanded Toolkit

In April 2025, ICE and the IRS signed a memorandum of understanding giving HSI access to employer tax records, including W-2 data and Social Security number matching information. This data-sharing agreement has significantly expanded HSI's ability to identify employers for investigation without an initial complaint.

What Employers Should Do Now

Conduct an I-9 self-audit. Review your existing I-9 forms for completeness and accuracy before the government does. Identify errors and correct them properly. Train your HR team. Ensure that every employee responsible for completing I-9 forms understands the current requirements. Develop a response plan. Know what to do if HSI agents arrive at your workplace. Employers are generally entitled to three business days to produce I-9 documentation in response to a Notice of Inspection.
