Importantly, updated USCIS guidance issued in October 2025 clarified that individuals already residing in the U.S., including those on currently valid H-1B visas, are generally not subject to this fee. A New Weighted Lottery System
For the FY 2027 H-1B cap registration season, USCIS has implemented a new weighted selection process under a final rule effective February 27, 2026. Rather than purely random selection, the new system increases the probability that H-1B visas are allocated to higher-skilled and higher-paid workers. This represents the most significant structural change to the H-1B lottery in nearly a decade.
